Terms and conditions
This document sets out your rights and obligations, and those of WebElements, in relation to your purchase of products and services through this site or any of the other WebElements sites. Statutory rights are not affected. By ordering a product you accept these terms and conditions. The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly before ordering products in case there are any changes.
Orders and availability
All orders are subject to acceptance and availability. Pricing of products are correct at the time of appearing on the web site but we reserve the right to change prices without prior notice. This will not affect any order you have made prior to any such changes. All available items are despatched usually within two working days from the UK.
Acknowledgement of order
When you have completed your order you will be sent an e-mail confirming your order. It will state what the ordered products are and the cost. This will also include applicable sales tax (VAT), shipping and packaging costs, and invoice details. If your order is unsuccessful you will be informed.
Your undertakings and warranties
You warrant that the information given on your order form is complete and correct. Specifically, name, your billing/shipping address/addresses, e-mail address, and telephone number must be accurate.
All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment, we will not be liable for any delay or non-delivery. We do not accepts payment by cash or any method not listed specifically on the WebElements shop web site. You must ensure that you are fully entitled to use the card at the time when you provide those details within the WebElements Shop, and that when you use the card, the card has available funds to cover all charges incurred on it in the course of buying from us. You must be able legally to enter into contracts for goods and services that you may buy here.
Tax and duties
Within the EU, the final price you pay will include VAT (a sales tax) on all goods and services where applicable. VAT will be calculated applied at the checkout. Elsewhere, VAT is not applied, but you agree to pay all applicable taxes and duties, if any, as required in your country. Any such taxes and duties are beyond the control of WebElements but WebElements will disclose the amount you paid for the goods if required.
Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from the WebElements shop. With prior authorization and within 7 days of delivery of a shipment, you may return any item you purchased from WebElements in its original condition, for a free replacement or a full refund (we will refund the shipping cost only if the return is a result of our error). To obtain prior authorization, you must please send an e-mail to email@example.com before making the return with the following details to order for us to authorize a return:
- Order number, together with your first and last name
- Item(s) you want to return
- Specify reason for return: damaged, received incorrect item or size, received duplicate item, quality of item not as expected, etc.
- Specify what action you would like us to take (replacement or refund?)
- Wait for our customer service team to e-mail you instructions regarding replacement or refund. Once we have received the returned goods, we will contact you by e-mail with a progress report regarding any refund.
If a replacement is necessary, we will reship it to you at no additional cost and we will assume shipping charges if the replacement is because of our error. If you request a refund, and the return is properly authorized, we will credit your the same card used for payment within 14 business days of our receiving your return. If your return is not due to our error, we will deduct the shipping costs from your refund.
Limitation of liability
Subject to any relevant consumer protection legislation to give you a refund, if you cancel your contract, if we do not perform the contract within 30 days, or other agreed timescale, our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction.
Loss and consequential loss
WebElements will not be liable to you or any third party for any indirect or loss or damage, or for any loss or consequntial loss of data, profit, revenue, business or management time, howsoever caused. You agree that the liability of WebElements under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed the sums paid or payable by you for your order.
WebElements places great importance on maintaining the security of the information that you provide and for this reason we use advanced Internet security system to safeguard your data. All the data that you send through, including your credit/debit card number and name and address, is encrypted and converted into code before it is transmitted across the Internet.
Purchase of Products
WebElements reserves the right, in our absolute discretion, to refuse to sell to any person and we shall not be required to give any reasons for such refusal.
Misuse of the WebElements site
WebElements reserves the right to suspend or terminate any account which, is, or appears to us, in our absolute discretion, to be, in breach of any of the provisions of this agreement.
Invalidity of Terms and Conditions
If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.
WebElements shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
Governing Law and Jurisdiction
Contracts between you and WebElements shall be governed by English Law and you and WebElements submit to the exclusive jurisdiction of the English courts.
